Why Hire a process server?

​From all corners of the world, legal corporations and collection agencies often use process servers.  Rather than tying up their own resources, they will often delegate this job to companies that facilitate this kind of service. Process Servers will take care of tasks such as serving of legal documents, filing of legal documents with the courts, skip tracing, and many other tasks.
Prior to offering this service, law enforcement agencies would handle this kind of legal process.  But, as you can imagine, this did put a strain on their resources and how they were delegating these tasks to officers.  So, as a result, Process Serving became a separate entity, allowing them to delegate this out to a third party.  Today, you will find Process Servers in most communities around the globe.
 

Who is a Process Server?
A process server takes on the task of serving legal documents on defendants or respondents involved in different legal or court cases.  Documents include such legal forms as divorce papers, restraining orders, summons to appear, subpoenas, and other legal documents.  They have 2 means of carrying out this process.  They can be done by personal service, where the court document is physically served upon an individual directly.  This is actually an option that any individual can do, ensuring that legal procedure is followed.  Or, alternatively, they can be done by ordinary service, which includes mailing, faxing, or emailing the documents.  We would urge any one who is planning on doing the document service themselves, reach out for advice first, as there are regulations that need to be strictly followed.  A Process Server will also perform document recovery and court filing.

Affidavit of Service
A notarized proof of service or affidavit of service must be executed and provided by a Process Server.  This is legal evidence that the documents have been served on the individual or company as per legal requirements.  The Process Server must adhere to the provincial and federal regulations regarding the service, depending on the province it is executed in.  And the regulations may vary from province to province.  It is the responsibility of the Process Server to be aware of what is required.

 The Responsibility of a Process Server
Serving of legal documents may appear to be a simple job but there is much about this that is not simple.  Legal court documents must be served correctly according to the provincial and federal requirements.  Failure to follow these procedures can have significant effect on legal actions before our courts.  Therefore, a Process Server must be responsible, efficient, and knowledgeable about legal implications of the task they perform.  Lawyers, Court Representatives, Investigative Firms, and individuals use Process Servers to perform this task because of the level of expertise they provide.
